Acceptable Use & Anti-Spam Policy

This Acceptable Use Policy ("AUP") outlines the acceptable and prohibited behaviors when using the ProsperGene and Prosperity Network platform, website, and affiliate tools. By participating as a user or affiliate, you agree to strictly abide by these rules. Our goal is to foster a safe, ethical, and high-quality environment that protects our brand and ensures fair opportunity for all members.

1. Anti-Spam Policy (Zero Tolerance)

ProsperGene enforces a strict zero-tolerance policy towards spam. Affiliates must comply with all international anti-spam laws, including the CAN-SPAM Act, CASL, and GDPR.

  • No Unsolicited Emails (UBE/UCE): You may not send bulk or automated emails to individuals who have not explicitly opted-in to receive communications from you.
  • No Purchased Lists: The use of purchased, rented, or harvested email lists is strictly prohibited.
  • No SMS/Messaging Spam: You may not send unsolicited mass text messages, WhatsApp broadcasts, or direct messages (DMs) on social media platforms to strangers.
  • Opt-Out Requirements: All email marketing must include a clear, functioning unsubscribe mechanism and your accurate physical mailing address.

2. System Abuse & Fraud Prevention

Any attempt to manipulate the ProsperGene compensation plan, matrix structure, or underlying software is strictly forbidden.

  • No Fake Accounts: You may not create "dummy," "ghost," or synthetic accounts to artificially inflate your matrix, achieve rank advancements, or trigger bonuses.
  • No Self-Dealing: Using your own credit cards to fund downline accounts or creating a web of interconnected accounts owned by a single entity is considered financial fraud.
  • No Automation/Botting: The use of automated scripts, scrapers, or bots to interact with the platform, harvest data, or automate sign-ups is prohibited.

3. Marketing Conduct & Ethical Promotion

As an independent affiliate, you are a brand ambassador. Your marketing efforts must be truthful, transparent, and compliant with FTC guidelines.

  • No Deceptive Income Claims: You may not guarantee income, promise a "get rich quick" timeline, or display lavish lifestyle images that imply guaranteed wealth. You must always provide a link to the official ProsperGene Income Disclosure Statement when discussing compensation.
  • No Unapproved Medical Claims: ProsperGene products are wellness supplements. You may not claim that our products diagnose, treat, cure, or prevent any disease. Stick strictly to corporate-approved product documentation.
  • Clear Disclosure: You must clearly identify yourself as an "Independent ProsperGene Affiliate" in all advertising and social media profiles. You may not represent yourself as a corporate employee or agent.

4. Cross-Recruiting & Poaching

To maintain a healthy network, we strictly enforce rules regarding network integrity.

  • No Internal Poaching: You may not actively recruit or solicit an existing ProsperGene member from another lineage to switch sponsors or join a different team.
  • No Cross-Promoting Competing Opportunities: While you are free to participate in other ventures, you may not use the ProsperGene network, events, or back-office tools to recruit ProsperGene members into a competing network marketing opportunity.

5. Enforcement & Consequences

Failure to comply with this Acceptable Use Policy will result in immediate disciplinary action to protect the network.

  • Investigation: Accounts flagged for AUP violations may be temporarily suspended pending investigation.
  • Account Termination: Confirmed violations, especially regarding spam or financial fraud, will result in immediate termination of the affiliate account.
  • Forfeiture of Commissions: If an account is terminated for violating this AUP, any unpaid commissions or bonuses will be permanently forfeited.
  • Legal Action: In cases of severe abuse, fraud, or reputational damage, ProsperGene reserves the right to pursue civil or criminal legal action.
